Read what I sent FPS District Administrator Judy Mueller today, with copy to Lisa Oszewski of FPS:

Your administration continues to disappoint on transparency.

Some background:

MAY 7, 2021: I made the following open records request to FPS.

Please furnish any documents that pertain to and include the most current and complete contract agreement with FPS District Administrator Dr. Judy Mueller that was finalized and put into effect in the time period between January 1, 2017, and today’s date.

MAY 18, 2021: FPS responded to my request.

JUNE 3, 2021: I made a follow-up to my request to FPS because the contract document forwarded to me did not spell out a monetary value for Mueller’s various health benefits. I asked in my follow-up, “What is that specific dollar amount/value?”

JUNE 14, 2021: FPS responded to my follow-up: The record of this information is located on the DPI website. 

These are records that are easily accessible for you to reach and disseminate in a reasonably short time without referring people to the disaster that is the non-user friendly DPI website. Why it takes your administration so long to respond is beyond me. However, I note that FPS DID send me your benefit information, albeit transferring me to another source.

Since then I have also requested salary and benefit information for your new assistant superintendent. Knowing how the aforementioned request was handled about benefits, I made sure my new request was crystal clear.

JULY 16, 2021: I made an open records request to FPS.

Please furnish any documents that pertain to and include the complete contract agreement with newly-hired FPS Assistant Superintendent Jessica Moe. Please include specific salary and benefit package information if it is not outlined in the contract.

JULY 27, 2021: FPS responded, but once again benefits information was not included.

JULY 27, 2021: I wrote to FPS: “Please include specific salary and benefit package information if it is not outlined in the contract. This was not fully answered. What are the specifics of her (Moe’s) benefit package?”

AUGUST 6, 2021: I heard from Lisa Oszewski of FPS: “I’m sorry Mr. Fischer, I have not yet received a response from HR to your additional question.  Let me check on the status for you.  Is it OK if I get back to you on Monday?” I replied yes.

AUGUST 9, 2021: I heard from Lisa Oszewski: “Thank you for your patience.  HR has informed me that a record of this information is posted annually to the DPI website.  It will be available there with regard to Dr. Moe in January.” I responded to Oszewski and to you: “I’m supposed to wait five months for information you have now? Judy Mueller, can you expedite this?”

So far I’ve heard nothing. Why was your information released to me but Moe’s information is now being kept in the dark? There is clear inconsistency between the manner in which my request for your contract was handled as compared to an identical request about Moe. Your failure or resistance to honoring my request about Moe seems to be a violation of the WI Open Records law.

I do not have any issues with Lisa Oszewski. She has made efforts to be accommodating. However, your administration continues to be evasive and not forthcoming with public records in a timely fashion, not just from me, but from other Franklin taxpayers.

Under the Wisconsin Open Records law, 19.31-19.39 I am requesting a copy of the following records:

Please furnish any documents that pertain to and include the complete contract agreement details with newly-hired FPS Assistant Superintendent Jessica Moe, specifically, those that include exact benefit package information if it is not outlined in the contract.

Should these records be in an electronic form, please forward to me electronically or place them on a readable computer disc or flash drive.

Should there be a cost for searching or copying these records, please tell me if those costs are more than $50.00. I am requesting a waiver of all costs because of the public interest involved. This information is not for any commercial use.

I request a response in writing within 10 days. If you expect a delay in your response beyond 10 days please inform me when you expect to release the records.

UPDATE:

In a nutshell, they don’t have the records, or so Judy Mueller claims. She did respond quickly, but not to my satisfaction. Here’s a portion of her response:

As you note, the District did not produce a record that sets forth the specific benefit package that Dr. Moe will receive, because the District is not in possession of a record that sets forth the specific benefits Dr. Moe has chosen to utilize among the benefits offered by the District to its employees.   The District offers its employees various benefits, and not all employees choose to utilize all of the benefits offered.  The District is not in possession of a record that identifies each specific benefit that Dr. Moe has chosen to utilize or forego.  Given your requests have sought the specific benefits package that Dr. Moe is receiving, the District did not locate any record responsive to that request, other than directing you to the records of the Department of Public Instruction, which is updated annually in January.

I replied to Mueller:

“The District is not in possession of a record that identifies each specific benefit that Dr. Moe has chosen to utilize or forego.  Given your requests have sought the specific benefits package that Dr. Moe is receiving, the District did not locate any record responsive to that request, other than directing you to the records of the Department of Public Instruction, which is updated annually in January.”

So what are you saying?

Moe hasn’t taken any benefits yet so there’s no record of it? I find that hard to believe.

Or she’s receiving some benefits but you have no record of them? I also find that hard to believe.

Somehow the district has a record of your benefits, but not Moe’s?

Your lack of transparency speaks volumes about how you manage the district.
